Terms of Service
Effective: May 15, 2026
These Terms of Service ("Terms") govern your use of the Aura mobile application (bundle ID: com.charlesjackson.aura) and website at getpulse.date (collectively, the "Service"), operated by Aura ("we," "us," or "our"), headquartered in Quebec, Canada. By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree to these Terms, do not use the Service.
1. Eligibility
To use Aura, you must:
- • Be at least 18 years old. Aura is a dating platform intended exclusively for adults. Age verification is enforced during account creation.
- • Have the legal capacity to enter into a binding agreement under the laws of your jurisdiction
- • Not be prohibited from using the Service under any applicable law or court order
- • Not have been previously terminated from the Service for violations of these Terms or Community Guidelines
- • Be genuinely seeking personal, romantic connections (Aura is not a platform for commercial solicitation, networking, or platonic friendship-only use)
By creating an account, you represent and warrant that you meet all eligibility requirements. We reserve the right to request additional age verification and to terminate accounts that we reasonably believe belong to underage users or users who do not meet these criteria.
2. Account Registration and Security
You may create an account using Sign-In with Apple or email-based magic link (one-time password) authentication. You are responsible for:
- • Maintaining access to the email address or Apple ID associated with your account
- • All activity that occurs under your account, whether or not you authorized it
- • Providing accurate, current, and complete profile information, including your real name, recent photos, date of birth, and city
- • Notifying us immediately at charlesdotdirect@gmail.com if you suspect unauthorized access to your account
You may only maintain one active account. Creating multiple accounts — including after a previous account was terminated for violations — is prohibited and grounds for immediate removal.
3. Your Content and Intellectual Property
You retain full ownership of all content you create on Aura, including profile photos, prompt answers, and messages. By posting content to the Service, you grant Aura a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute that content solely for the purpose of operating, providing, and improving the Service. This license terminates when you delete the specific content or your account.
You represent and warrant that:
- • All content you post is accurate and not misleading
- • Your photos are recent (taken within the last two years) and clearly depict you
- • You have the right to share all content you upload and it does not infringe any third party's intellectual property, privacy, or other rights
- • Your content does not violate our Community Guidelines or any applicable law
The Aura name, logo, branding, software, user interface designs, AI-generated insight formats, and all other intellectual property associated with the Service are owned by Aura and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on our intellectual property without prior written permission.
4. Acceptable Use and Prohibited Conduct
You agree to use Aura in accordance with these Terms and our Community Guidelines. The following conduct is strictly prohibited:
- • Harassment and abuse: threatening, stalking, intimidating, bullying, or sending unwanted sexual content to any user
- • Hate speech: promoting violence or discrimination based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic
- • Deception: creating fake, misleading, or impersonating profiles; using someone else's photos; misrepresenting your identity, age, or intentions
- • Explicit content: uploading or sharing nudity, sexually explicit imagery, or graphic violence in profiles or messages
- • Commercial exploitation: using the Service for advertising, solicitation, promotion, or driving traffic to external websites or services without authorization
- • Minors: using the Service if you are under 18, or engaging in any conduct that endangers minors
- • Privacy violations: sharing other users' personal information, photos, or conversation screenshots without their explicit consent
- • Technical abuse: attempting to circumvent security features, rate limits, or access controls; using automated tools, bots, or scripts; reverse engineering, decompiling, or disassembling any part of the Service; interfering with the Service's infrastructure
- • Aura abuse: using the Aura proximity feature to stalk, follow, or track other users; deliberately remaining near a user who has expressed discomfort; attempting to circumvent Ghost Mode protections
- • Illegal activity: engaging in or promoting any activity that violates applicable local, provincial, federal, or international law
Violations may result in a warning, temporary suspension, or permanent termination of your account, at our sole discretion and depending on the severity and pattern of violations.
5. AI Features and Disclaimer
Aura uses artificial intelligence to provide conversation insights and coaching. By enabling AI features, you acknowledge and agree:
- • AI analysis is opt-in and disabled by default. You must explicitly enable it during onboarding or in account settings.
- • When AI Insights are enabled, all participants in your conversations are notified via a visible indicator. You may not use AI Insights covertly.
- • Some AI processing occurs on your device using Apple Foundation Models, where data never leaves your device. More complex analysis is processed server-side through our Supabase Edge Functions.
- • Aura will never write, draft, or suggest messages on your behalf. Every message in every conversation is authored entirely by the user who sent it.
- • AI-generated insights — including Conversation Pulse scores, Chemistry Scores, Date Radar timing, coaching tips, flag detection, date suggestions, and personal reports — are informational suggestions only. They are not guarantees, predictions, or professional advice.
- • AI analysis is limited to observable conversation patterns (message frequency, response times, question ratios, topic continuity, message length). It does not make emotional, psychological, or behavioral inferences about other users.
- • You should not rely on AI-generated insights as the sole basis for decisions about your relationships, safety, or personal well-being.
- • You can disable AI Insights at any time from your account settings. Disabling stops all future analysis; previously generated insights remain accessible until you delete them or your account.
Aura makes no warranty regarding the accuracy, reliability, or completeness of AI-generated content. AI insights may be incorrect, incomplete, or inapplicable to your specific situation. Dating outcomes depend on many factors beyond what any AI system can measure or predict.
6. Subscriptions and Payments
Aura offers a free tier and paid subscription plans (collectively, "Premium"). Paid subscriptions are billed exclusively through the Apple App Store as auto-renewing subscriptions.
- • Payment: is charged to your Apple ID account at the time of purchase confirmation
- • Auto-renewal: subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your plan) unless auto-renew is turned off at least 24 hours before the end of the current period
- • Renewal charges: your Apple ID account will be charged for renewal within 24 hours prior to the end of the current billing period at the rate of your chosen plan
- • Free trial: if a free trial is offered, any unused portion of the trial period is forfeited when you purchase a subscription
- • Management and cancellation: you can manage or cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Aura cannot cancel subscriptions on your behalf.
- • Refunds: all refund requests are processed by Apple in accordance with Apple's refund policy. Aura does not handle refunds directly. To request a refund, visit reportaproblem.apple.com.
- • Price changes: we reserve the right to change subscription pricing. Any price change will not affect your current billing period. You will be notified of price changes before your next renewal, and you may cancel if you do not accept the new price.
Premium features — including Aura proximity detection, advanced AI insights, and expanded daily profile limits — are available only to active subscribers. If your subscription expires or is cancelled, you will retain access to free-tier features but lose access to Premium features.
7. Safety, Reporting, and Moderation
Aura provides in-app tools to report and block other users. Our moderation practices include:
- • Reporting: you can report any user for violating Community Guidelines. Reports are reviewed by our moderation system (including our moderate-reports Edge Function) and appropriate action is taken.
- • Blocking: when you block a user, they can no longer see your profile, send you messages, or detect you via Aura. Blocking is immediate and silent — the blocked user is not notified.
- • Enforcement: depending on the severity and nature of the violation, we may issue a warning, temporarily suspend the account, or permanently remove the user. Serious violations (threats, illegal activity, underage usage) result in immediate permanent removal.
- • Law enforcement: we may report illegal activity to law enforcement authorities and cooperate with lawful investigations
Important: Aura is a platform for facilitating introductions between adults. We do not conduct background checks on users and cannot verify the identity, intentions, criminal history, or conduct of any user. You are solely responsible for your safety when interacting with other users, both online and in person. Always meet in public places, inform someone you trust of your plans, and trust your instincts.
8. Account Termination
8.1 Voluntary Deletion
You may delete your account at any time from Account > Delete account in the app. Account deletion is immediate and permanent — all personal data, photos, messages, matches, AI-generated insights, and Aura proximity records are irreversibly deleted. Deleting your account does not automatically cancel an active Apple App Store subscription. You must separately cancel your subscription through your Apple ID settings to avoid further charges.
8.2 Termination by Aura
Aura reserves the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, our Community Guidelines, or applicable law. In cases of serious violations — including threats of violence, illegal activity, underage usage, or repeated violations — termination is immediate and you may be permanently barred from creating new accounts. We are not obligated to provide a reason for termination, though we will endeavor to do so where possible.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PULSE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WITHOUT LIMITING THE FOREGOING:
- • We do not guarantee that you will find a match, receive messages, or achieve any particular outcome from using the Service
- • AI-generated insights, scores, and recommendations are informational tools only and may be inaccurate, incomplete, or inapplicable
- • We do not guarantee the accuracy or completeness of user profiles or the identity of other users
- • Aura proximity detection depends on hardware capabilities, environmental factors, and other users' settings, and may not function in all circumstances
- • We are not responsible for the conduct of any user, whether on or off the platform
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE LAWS OF QUEBEC AND CANADA, PULSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM:
- • Your use of or inability to use the Service
- • Interactions with other users, whether online or offline, including any meetings arranged through the Service
- • Unauthorized access to or alteration of your account or data
- • Reliance on AI-generated insights, scores, or recommendations
- • Inaccuracy of Aura proximity detection or failure of the Aura feature to function as expected
- • Any conduct or content of any third party on the Service
- • Any content or data obtained from or through the Service
IN NO EVENT SHALL PULSE'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO PULSE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify, defend, and hold harmless Aura, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your content; (c) your violation of these Terms or the Community Guidelines; (d) your violation of any applicable law or regulation; or (e) your violation of any rights of another person or entity.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. The Civil Code of Quebec and the Consumer Protection Act (Quebec) apply to your use of the Service to the extent you qualify as a consumer under those laws.
Dispute resolution process:
- • Step 1 — Informal resolution: before initiating any formal proceedings, you agree to contact us at charlesdotdirect@gmail.com and attempt to resolve the dispute informally for at least 30 days
- • Step 2 — Mediation: if informal resolution is unsuccessful, either party may propose mediation before a mediator mutually agreed upon by both parties, conducted in Quebec City or Montreal, Quebec
- • Step 3 — Jurisdiction: if mediation is unsuccessful or not pursued, you agree that any legal action shall be brought exclusively in the courts of the judicial district of Quebec (Province of Quebec, Canada), and you consent to the personal jurisdiction of those courts
Nothing in this section limits your right to file a complaint with the Office de la protection du consommateur (OPC) or to seek injunctive relief in any court of competent jurisdiction for violations of your intellectual property rights.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect. The failure of Aura to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
14. Entire Agreement
These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Aura regarding the Service and supersede all prior agreements, understandings, and communications, whether oral or written. Any additional terms or conditions presented through the Service (such as in-app purchase confirmations) are incorporated by reference.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account. The "Effective" date at the top of this page indicates when these Terms were last revised.
